These Terms and Conditions set out the basis on which Waste Clearance West Hampstead provides waste clearance, rubbish removal and associated services to residential and commercial customers. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any waste collection, rubbish removal, clearance, loading, transportation or related service provided by us.
1.2 Customer, you or your means the person, company or organisation requesting or using the Service.
1.3 We, us or our means Waste Clearance West Hampstead, the provider of the Service.
1.4 Booking means a confirmed request for our Service made by telephone, email, online form or any other method accepted by us.
1.5 Waste means any items, materials, rubbish or refuse agreed to be collected and removed as part of the Service, excluding any items we are not permitted to take in law or under these Terms and Conditions.
1.6 Service Area means the locations in which we offer waste clearance services, including West Hampstead and surrounding areas, as updated by us from time to time.
2.1 We provide waste clearance and rubbish removal services for domestic and commercial customers within our Service Area. This may include household waste, furniture, appliances, garden waste, light construction waste and general rubbish, subject to these Terms and Conditions.
2.2 We reserve the right to refuse to collect any items that are hazardous, prohibited by law, unsafe to handle, or fall outside the scope of our standard Service. This may include, but is not limited to, asbestos, clinical waste, chemicals, gas cylinders, certain electrical items, pressurised containers and any substance we reasonably believe could present a risk to health, safety or the environment.
2.3 We may, at our discretion, agree to provide additional services such as disassembly of items, light dismantling or minor labour beyond standard loading. Any such additional services will be agreed in advance and may incur extra charges.
2.4 All Services are subject to availability and may be limited during peak periods, public holidays or when access conditions make it impractical or unsafe for us to operate.
3.1 You may make a Booking for waste clearance by contacting us via telephone, email or an online enquiry form. When making a Booking, you must provide accurate and complete information about the type and quantity of waste, the collection address, access details, parking restrictions and any relevant site conditions.
3.2 Any quotations provided by us, whether verbally or in writing, are based on the information you supply at the time of enquiry. Quotations are an estimate only and may be revised if the actual waste volume, type, weight or access conditions differ from those described.
3.3 We will confirm the date and, where possible, the collection time window for your Booking. Your Booking is only accepted when we send a confirmation or otherwise expressly agree to provide the Service. We reserve the right to decline a Booking at our discretion.
3.4 You are responsible for obtaining any necessary permissions for our vehicles to access the collection point, including parking permits, building access authorisations and relevant permissions from landlords, managing agents or local authorities where applicable.
4.1 Our prices may be based on volume, weight, type of waste, labour time, access difficulty or a combination of these factors. We will explain the pricing basis at the time of Booking.
4.2 Quotations are provided in good faith based on the information you provide. If on arrival we find that the waste volume, composition or access differs significantly from what was described, we may adjust the price accordingly. Where the price needs to be revised, we will explain the reasons and seek your agreement before proceeding.
4.3 Our prices may include reasonable labour for loading waste from an accessible location. Where extra labour is required due to poor access, excessive distance to our vehicle, large numbers of stairs, the need to dismantle items or other complicating factors, additional charges may apply.
4.4 Unless expressly stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes, duties or charges that may be imposed by law.
5.1 Payment is due in full on completion of the Service, unless otherwise agreed in writing prior to the Booking. We may, at our discretion, require a deposit or full payment in advance for certain jobs.
5.2 We accept payment by cash, debit or credit card, bank transfer or other payment methods we may make available from time to time. You must ensure that funds are available and that payment details provided are correct.
5.3 Where we agree to invoice a business or organisation, payment must be made within the agreed credit period. If no period is agreed, payment is due within 14 days of the invoice date.
5.4 If you fail to make payment when due, we may charge interest on the overdue sum at the statutory rate and may recover from you all reasonable costs incurred in pursuing the debt, including legal and collection costs.
6.1 You may cancel or amend your Booking by contacting us as soon as possible. Cancellation or amendment is only effective once we have confirmed it.
6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless we have incurred specific costs or ordered equipment or services specifically for your Booking.
6.3 If you cancel within 24 hours of the scheduled collection time, we may charge a reasonable cancellation fee to cover our administrative costs and any loss of opportunity to allocate the slot to another customer.
6.4 If we attend the collection address at the agreed time and are unable to carry out the Service due to reasons within your control, including but not limited to lack of access, absence of an authorised person, failure to provide required permissions, or where the waste is not available or differs substantially from what was described, we may charge a missed collection fee or a call-out charge.
6.5 We reserve the right to cancel or reschedule the Service in the event of adverse weather, vehicle breakdown, staff illness, unsafe site conditions or other circumstances beyond our reasonable control. We will notify you as soon as reasonably practicable and arrange a new collection time. We shall not be liable for any loss or inconvenience arising from such cancellations or delays.
7.1 You must ensure that the waste to be collected is clearly identified and separated from items that are not to be removed. Our staff will not be responsible for deciding which items are to be taken beyond what you have clearly indicated.
7.2 You are responsible for ensuring safe and reasonable access to the collection point. This includes providing accurate address details, ensuring that access routes are clear, safe and unobstructed, and notifying us of any potential hazards, restricted access, parking issues or time limits.
7.3 You must not place dangerous, prohibited or unlawful items for collection. If we discover such items at any time, we may refuse to handle them, require you to remove them, or arrange specialist disposal at your cost if agreed in advance.
7.4 You confirm that you either own the items to be removed or have full authority from the owner to dispose of them. You shall indemnify us against any claims from third parties alleging that the disposal of items was unauthorised or unlawful.
8.1 We operate in accordance with applicable UK waste management and environmental regulations. We will transport, handle and dispose of waste using authorised facilities and will take reasonable steps to ensure that waste is managed responsibly.
8.2 Once collected, ownership of the waste transfers to us, provided that such waste is lawful and safe for us to handle. If we subsequently discover that waste is hazardous or prohibited, we may return it to you or arrange specialist handling at your cost, where permitted by law.
8.3 We may issue, or arrange for the issue of, appropriate waste documentation as required by law for certain types of waste or commercial contracts. You must retain copies of any documentation we provide for your own records.
8.4 We will not be responsible for any penalties, fines or legal consequences arising from your failure to comply with waste regulations prior to our collection, including unlawful storage, fly-tipping or improper segregation before we attend.
9.1 Our Service does not include deep cleaning, removal of fixed structural elements, major demolition or construction work, plumbing, electrical disconnection of hard-wired appliances, or removal of items that require specialist contractors unless expressly agreed in advance.
9.2 We do not guarantee that all waste can be removed in a single visit, particularly where access, vehicle capacity or time constraints apply. In such cases, we may offer to schedule additional visits at an agreed cost.
9.3 Time slots are approximate and may vary due to traffic, previous jobs, access issues and other factors. We will use reasonable efforts to attend within the agreed window but do not accept liability for minor delays.
10.1 We will exercise reasonable care and skill in providing the Service. However, our liability to you in connection with the Service is limited as set out in this clause.
10.2 We shall not be liable for any indirect, consequential or economic loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the Service or these Terms and Conditions.
10.3 Our total liability for any loss or damage arising from our negligence, breach of contract or otherwise shall be limited to the price paid or payable for the specific Service giving rise to the claim, except where such limitation is not permitted by law.
10.4 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
10.5 You must notify us in writing of any claims for loss or damage as soon as reasonably practicable and in any event within 7 days of completion of the Service. We may require supporting evidence and reasonable opportunity to investigate any alleged loss or damage.
10.6 We accept no liability for loss or damage where our employees or contractors are requested to carry items in a manner that is unsafe, unreasonable or contrary to our professional judgement, or where items are fragile, poorly constructed or already damaged.
11.1 We maintain insurance cover appropriate for the nature of our waste clearance operations. Details of our insurance may be made available upon reasonable request.
11.2 It remains your responsibility to ensure that your own property and contents are adequately insured and to notify your insurer where necessary of any planned waste clearance or removal activity.
12.1 If you are dissatisfied with any aspect of our Service, you should notify us as soon as possible, providing full details of your concerns.
12.2 We will investigate your complaint and, where appropriate, may request further information or evidence. We aim to resolve complaints promptly and fairly, and may offer remedial action, a partial refund or other resolution where we consider it reasonable to do so.
13.1 We will collect and process personal information about you for the purposes of managing your Booking, providing the Service, processing payments and communicating with you.
13.2 We will handle your personal data in accordance with applicable data protection laws. We will not sell your personal data to third parties and will only share it where necessary to deliver the Service, comply with legal obligations or with your consent.
14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect for new Bookings made after the updated terms are published or otherwise made available to you.
14.2 The Terms and Conditions in force at the time of your Booking will apply to that Service, unless a change is required by law or with your express agreement.
15.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a competent authority, that provision shall be considered severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.
